Motions and Pleadings

CHALLENGES: Now that the NRC has docketed the License Application prospective hearing participants have submitted their challenges, or "contentions," to elements of the license request. Links to those contentions are below. DOE has responded to most of the contentions submitted by prospective hearing participants and links to those responses can be found under each entities contention link below.

The Nevada Counties of Churchill, Esmeralda, Lander & Mineral formed an agreement to combine their forces and submit challenges to the DOE's.

PARTICIPANTS: The commission panel has issued a "Memorandum and Order" accepting 299 challenges to the License Application. Churchill County, part of the Four Counties has 4 challenges accepted and were given full standing in the proceedings. The DOE did not appeal any of the challenges.

HEARINGS: The Nuclear Waste Policy Act of 1982 calls for NRC review to take three years, but allows the commission to ask Congress for an additional year. NEW - Establishment of Atomic Licensing and Hearing Boards (January 17th, 2009) DECISION: The panels will recommend to the full commission whether the Energy Department should be licensed to proceed with plans for the repository 90 miles northwest of Las Vegas. Current schedule date for decision is March 13, 2013.
